Under Article 14 of the Swiss Data Protection Act (FADP), companies based outside Switzerland must appoint a representative in Switzerland if they process personal data of individuals in Switzerland and the following conditions are met:
- The data processing takes place in connection with the provision of goods or services or as part of behavioural monitoring (e.g. online tracking) in Switzerland; and
- the data processing is extensive, regular and poses a high risk to the privacy of the data subjects.
Under the DPA, the representative acts by law as the official point of contact for data subjects and for the Federal Data Protection and Information Commissioner (FDPIC).
